01 – BUYING PROPERTY
Buying In Marbella
Key questions about eligibility, paperwork, mortgages, purchasing remotely and the typical acquisition process.
Can foreigners buy property in Marbella?
Yes. Spain allows non-residents of any nationality to buy and own property. Spanish residency is not required to complete a purchase.
Do I need an NIE number to buy a property?
Yes. The NIE, or Número de Identificación de Extranjero, is required to complete the purchase, pay taxes and register ownership.
Which documents should an international buyer prepare?
At minimum, you will need a valid passport and NIE. In practice, buyers should also prepare banking and compliance documents such as proof of income, proof of funds and information regarding the origin of funds.
Your lawyer and bank will confirm the exact requirements for your circumstances.
How much should I budget for buying costs?
As a general planning range, buyers should allow approximately 8,5%–9,5% above the purchase price for a resale property and approximately 12–13% for a newly built property.
Actual costs depend on the property, tax treatment, legal structure and financing.
Can non-residents obtain a Spanish mortgage?
Yes. Spanish banks can finance non-resident buyers, subject to income, affordability, nationality, property valuation and internal bank policy. Financing is generally calculated on the lower of the purchase price or bank valuation.
Can I start or complete the purchase remotely?
Yes. Video viewings, electronic document exchange and a notarised power of attorney can allow much of the process to be handled remotely. We nevertheless recommend visiting the property personally whenever possible.
How long does the purchase process usually take?
A straightforward resale transaction often completes within approximately four to eight weeks after agreement, although the timing depends on due diligence, financing, documentation and the terms negotiated with the seller.
02 – SELLING PROPERTY

How long does it take to sell a property in Marbella?
The timeline depends on price, location, condition, presentation, demand and the strength of the marketing strategy. Correctly positioned properties generally attract serious buyers more quickly.
Who normally pays the estate agency fee?
In most Marbella transactions, the seller pays the agreed estate agency fee, unless a different arrangement has been made in writing.
Which documents are needed to sell?
Typical documentation includes the title deed, Nota Simple, latest IBI receipt, community fee confirmation, energy performance certificate and, where applicable, the First Occupation Licence or equivalent planning documentation.
Is an Energy Performance Certificate required?
Yes. A valid Energy Performance Certificate is generally required when marketing and selling a property.

Should I renovate before selling?
Not always. Some homes benefit from targeted improvements, staging or cosmetic updates, while others are better positioned as renovation opportunities. We assess each property in relation to its likely buyer profile and resale potential.
03 – TAXES & COSTS
Understanding The Main Costs
A concise overview of purchase taxes, annual ownership costs and taxes that may apply when selling.
Which taxes apply when buying property?
The applicable taxes depend mainly on whether the property is a resale or a new build, and on the buyer’s legal and tax profile. Resale properties are generally subject to Transfer Tax, while newly built homes are generally subject to VAT and Stamp Duty.
Are there reduced tax regimes for property investors?
Andalusia has offered reduced transfer tax treatment in certain cases for qualifying property professionals purchasing for resale. These regimes are strictly regulated and can change, so eligibility should always be confirmed with a qualified tax advisor before purchase.
Does a seller pay Capital Gains Tax?
Capital Gains Tax may apply to the profit made on sale. The calculation depends on acquisition cost, eligible expenses, sale costs, ownership profile and tax residency.
What is Plusvalía Municipal?
Plusvalía Municipal is a local tax connected to the increase in the cadastral value of the land during the period of ownership. It is normally paid by the seller, unless otherwise agreed.
What annual costs should property owners expect?

What is the 3% retention for non-resident sellers?
When a non-resident sells Spanish property, the buyer is generally required to retain 3% of the sale price and pay it to the Spanish Tax Agency on account of the seller’s potential tax liability.
04 – LEGAL & RESIDENCY

Is Spain’s property Golden Visa still available?
No. Spain’s real estate-based Golden Visa route ended in April 2025 and new applications under that route are no longer accepted.
Does buying a property automatically give me residency?
No. Property ownership and immigration status are separate. Other residency routes may be available depending on nationality, income, work situation and personal circumstances.
Should I appoint an independent lawyer?
Yes. We strongly recommend appointing an independent Spanish lawyer experienced in real estate transactions to carry out legal and planning due diligence, review contracts and represent your interests.
Do I need a Spanish bank account?
A Spanish bank account is not always a strict legal requirement for the purchase itself, but it is strongly recommended for taxes, utilities, community fees and future property-related payments.
What does legal due diligence include?
Due diligence typically includes confirmation of ownership, debts, charges, planning status, building licences, occupancy documentation, community obligations, tax payments and any restrictions affecting the property.

Which Marbella areas are best for buyers?
The best area depends on lifestyle, budget and intended use. Popular prime locations include the Golden Mile, Sierra Blanca, Nueva Andalucía, La Zagaleta, El Madroñal, Guadalmina and selected areas of Estepona.
Are international schools available?
Yes. Marbella and the wider Costa del Sol offer a strong selection of international schools with British, international and other European curricula.
Can I rent out my property?
Yes, subject to applicable community rules, local planning restrictions, registration requirements and Andalusian rental regulations. Holiday rentals require particular attention to licensing and compliance.
Can I renovate after buying?
Yes, subject to planning, community and technical requirements. Through our local partners, buyers can access architecture, interior design, construction and renovation guidance.
